Настоящее уведомление определяет принадлежность исключительных прав на контент, размещённый на официальных ресурсах правообладателя, а также устанавливает ограничения на его использование.

• по ст. 1515 ГК РФ — ответственность за незаконное использование товарного знака — компенсация до 5 млн руб. либо в двукратном размере стоимости товаров, на которых размещён товарный знак, или в двукратном размере стоимости права использования товарного знака.

Охраняемые права:

• исключительные права на объекты авторского права: произведения, изображения, видеоматериалы, текстовые описания, графические элементы и иные материалы, принадлежащие ООО «БАЭМАР»;

• исключительное право на товарный знак ledBEled, принадлежащее Бацеву Эдуарду Викторовичу;

• право ООО «БАЭМАР» использовать товарный знак ledBEled в пределах прав, предоставленных правообладателем товарного знака.

использование в карточках товаров, рекламных материалах, презентациях и иных коммерческих целях;
использование обозначения ledBEled и соответствующего логотипа без разрешения правообладателя.

Нарушение исключительных прав влечёт ответственность в соответствии с действующим законодательством Российской Федерации.

Правообладатель вправе требовать:

удаления незаконно размещённых материалов;
удаления контента, защищённого авторским правом, используемого без разрешения;
прекращения нарушения исключительных прав;
прекращения незаконного использования товарного знака;
выплаты компенсации и возмещения убытков в случаях, предусмотренных законом.
